Decree No. 122/2020/ND-CP of The Gorverment on regulating coordinating documents, linking procedures for enterprise, branch, representative office registration and reporting on employing employees, issuing social insurance codes of the units, registering to use corporate invoices.
Effective date 15 October 2020
“On 15 October 2020, the Government issued Decree 122/2020/ND-CP regulating coordinating documents, linking procedures for enterprise, branch, representative office registration and reporting on employing employees, issuing social insurance codes of the units, registering to use corporate invoices.
Accordingly, the principle of coordinating and linking between state management agencies is prescribed as follows:
- Business registration agency is the focal point to receive dossiers and return results of settlement of enterprise registration procedures, operation registration of branches and representative offices, and to report on labor use. issue number of units participating in social insurance, register to use invoices of the enterprise;
- The coordinating and linking between business registration agencies, social insurance agencies, state management agencies in charge of labor, and tax agencies is done through the method of connecting and sharing digital data between information technology systems;
- Labor state management agencies, social insurance agencies and tax agencies do not require enterprises, branches or representative offices to provide copies of the enterprise registration certificate or registration certificate. branch operations, representative offices, business registration information shared from the business registration agency, except for the name, enterprise number, branch, representative office when performing the procedures administrative related.
Based on the above principles, the Decree also specifies clearly the process of coordinating documents, linking procedures. In which, there are two specific outstanding processes as follows:
- Dossier of joint coordination of registration procedures for enterprise establishment, branch office, representative office, declaration of labor use, issuance of social insurance number of units, registration of use of chemical business application.
Accordingly, the Decree issues new forms of application for enterprise registration corresponding to Appendices I-1, I-2, I-3, I-4 and I-5 to replace the previous business registration forms in use.
- Joint coordination process between business registration office and social insurance agency
- After registration for establishment or there is a change in the contents of an enterprise, branch or representative office, the business registration agency will share it with the social insurance agency;
- The enterprise code, branch number, representative office number is used as the number of units participating in insurance.”
