Circular No. 21/2020/TT-BCT of the Ministry of Industry and Trade to provide regulations on procedures for granting of electricity activity licenses

On September 09th, 2020, the Ministry of Industry and Trade issued the Circular No. 21/2020/TT-BCT to provide regulations on procedure for granting of electricity activity licenses:

  1. The requirement of must having electricity activity license is applied for individual/ organization engaged in electricity activities in the fields of electricity consultancy, electricity generation, electricity transmission, electricity distribution, electricity wholesale, electricity retail.
  1. Exemptions for requirement of electricity activity licenses include: Generating electricity for self-use without selling electricity to other organizations or individuals; Generating electricity with installed capacity of up to 01 MW to sell electricity to other organizations and individuals; Electricity trading in rural, mountainous and island areas purchasing electricity with a capacity of less than 50 kVA from the distribution grid to sell electricity directly to electricity users in rural, mountainous and island areas; Regulating the national electricity system and administering electricity market transactions.
  1. Limitation of activities in the field of electricity activity license:
  • Specialized electricity consultancy has a nationwide operation scope;
  • Power transmission and distribution fields have scope of activities within the scope of management and operation of specific power grids;
  • Electricity wholesaling and retailing have scope of activities in specific areas;
  • Power generation has the scope of activities for each power plant.

Circular No. 21/2020/TT-BTTT provides regulations on issuing the certificate of free sale of goods in the region of information and communication

Effective date: November 26th, 2020

On September 07th, 2020, the Ministry of Information and Communication issued the Circular No. 21/2020/TT-BTTT to provide regulations on issuing the certificate of free sale of goods in the field of information and communication. Some highlight of the Circular can be mentioned as follow:

  1. This Circular details the issuance of Certificate of Free Sale (CFS) on the List of goods and CFS management competence of the Ministry of Information and Communications, including: agency handling dossiers for CFS issuance; CFS application form; Application form for amendment, supplement / re-issue of CFS; CFS form.
  2. The Ministry of Information and Communications shall issue CFS to exported goods on the List of goods and CFS management competence of the Ministry of Information and Communications specified in Appendix V of Decree No. 69/2018/ND -CP dated on May 15th, 2018 of the Government details a number of articles of the Law on Foreign Trade Management.
  3. Traders are not required to submit CFS with HS code of imported goods on the List of goods and CFS management competence of the Ministry of Information and Communications specified in Appendix V of Decree No. 69/2018/ND-CP dated May 15th, 2018 of the Government detailing a number of articles of the Law on Foreign Trade Management.
